1  Who This Is Between

These terms are an agreement between you and hOEM Collective LLC, the maker of hOEM ("we", "us"). By downloading or using hOEM you accept them. If you do not, please do not use the app.

2  Age

hOEM is for people aged 13 and over. If you are under 18, please use it with the knowledge of a parent or guardian.

3. WHAT hOEM IS

hOEM is an app of quiet places — a coastal walk, a tide pool that answers your hand and shows you your own reflection, three worlds, and a place where you can hum and hear your humming joined to other people's. It is made to be used for a few minutes at a time.

Part of it is free and the rest is a paid subscription. Section 8 sets out where the line falls, what it costs and how to stop paying.

4. WHAT hOEM IS NOT

hOEM is not a medical device, a treatment, a therapy or a diagnostic tool. It does not treat, cure, prevent or diagnose anything. Nothing in the app, on our website or in anything we publish is medical, psychological or health advice.

If you are unwell, distressed, or in any difficulty, please speak to a doctor or a qualified professional. If you are in crisis, contact your local emergency service. Do not use this app instead of getting help.

Some of what is in hOEM — being invited to look at your own face, being alone with your own breath, hearing your voice among other people's — can bring up strong feelings. You can stop at any point, and nothing in the app will ask you to continue.

5  Your Permission To Use It

We give you a personal, non-exclusive, non-transferable licence to use hOEM on devices you own. You may not copy, sell, rent, reverse-engineer or redistribute the app, and you may not extract the video, audio, images or text from it for any purpose.

Everything in hOEM that we made — the footage, the recordings, the writing, the design, the name and the mark — belongs to us and stays ours.

6  Your Humming

Your humming is yours. It stays yours, and we claim no ownership of it.

Humming is the one thing in hOEM that leaves your phone. When you hum, the recording is sent to us and mixed into a single continuous sound built from many people's humming, which is what other people hear. Our Data & Privacy page sets out exactly what happens to it.

WHAT YOU ARE GIVING US PERMISSION TO DO

By humming, you give us permission to store your recording and to include it in that combined sound, and to let other people in hOEM hear the combined sound. That permission is limited to this: we may not sell your recording, licence it to anyone else, play it on its own, or use it to advertise anything.

You can withdraw it. Write to us and we will delete your recording and take it out of the mix the next time that sound is rebuilt. What cannot be undone is a copy of the combined sound that has already been heard — once many voices are mixed together, no single voice can be taken back out of it.

You are responsible for what you record, including not recording anyone who has not agreed to it.

7  Using It Fairly

Please do not use hOEM to break the law, to interfere with how it works, to try to gain access to parts of it that are not yours, or to record anything unlawful or anything that infringes someone else's rights.

8  Paying For It

WHAT IS FREE

You can open hOEM and take the walk — the archway, the coast, the descent, the tide pools — and arrive at the place where the three worlds are offered, without paying anything and without an account. That part stays free. You can return to it as often as you like.

WHAT IS PAID

Choosing a world, and everything past that choice, requires a subscription. That includes the worlds themselves, the mirror and the humming.

You will be told this at the moment you choose a world, before anything is charged and before you are asked for anything. You will never be charged without being shown the price first.

While hOEM is in testing, everything is open and nothing is charged. These terms describe the subscription for when it begins.

HOW THE SUBSCRIPTION WORKS

• The subscription is [SUBSCRIPTION NAME].
• It runs for [PERIOD] and costs [PRICE] for that period.
• Payment is taken by Apple and charged to your Apple Account when you confirm the purchase. We never see or hold your card details.
• It renews automatically for the same period at the same price, unless you turn off automatic renewal at least 24 hours before the current period ends.
• Apple charges the renewal within the 24 hours before the current period ends.
• You can manage the subscription, and turn off automatic renewal, in your Apple Account settings after purchase. We cannot do it for you and cannot see your subscription except as Apple reports it to us.
• If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
• Prices may change. If they do, Apple will tell you and ask you before any different amount is taken, and you can decline and keep the current period.

RESTORING A PURCHASE

If you get a new phone, reinstall hOEM, or lose access for any other reason, the app can restore a subscription you already hold. There is a way to do that on the subscription screen, and it costs nothing.

REFUNDS

Purchases are made through Apple, so refunds are handled by Apple under their terms, not by us. We cannot issue a refund for an App Store purchase.

9  Your Account

An account is created when you subscribe, and not before. The free walk needs no account.

HOW IT IS MADE

Accounts are made with Sign in with Apple. You do not choose a password and we do not hold one. If you use Apple's Hide My Email, we receive a relay address and never your real one.

WHAT IT IS FOR

The account records that you hold a subscription, so that what you have paid for is there on any device you sign in to with the same Apple Account. It is also what your humming is held against, so that you can ask for a recording to be removed.

KEEPING IT YOURS

The account belongs to you and is for your use. Do not share access to it. You are responsible for what is done through it and for keeping your Apple Account secure. If you believe someone else has used your account, write to us.

DELETING IT

You can delete your account from inside the app. Deleting it removes the record we hold of you and the recordings held against it, and it cannot be undone.

Deleting your account does not cancel your subscription and does not refund it. Subscriptions are cancelled through your Apple Account settings, and until you cancel there, Apple will keep charging.

We may suspend or close an account that is used to break these terms.

10  It Will Change

hOEM is being made. Screens will change, be added and be removed. We may change or stop parts of it, or the whole of it, at any time. We cannot promise any particular part of it will always be there.

If we remove something substantial that you are paying for, you can cancel your subscription through Apple and stop paying for it from the next period.

11  No Warranty

hOEM is provided as it is. To the fullest extent the law allows, we make no warranties of any kind about it — not that it will be uninterrupted, error-free, or fit for any particular purpose.

Some places do not allow warranties to be excluded, in which case the above applies only as far as the law permits.

12  Liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, arising from your use of hOEM.

Apart from your humming, everything hOEM keeps is stored only on your phone, so IT IS NOT BACKED UP BY US AND CANNOT BE RECOVERED BY US. If you delete the app, or lose or reset your phone, what was in it is gone.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

13  Ending It

You may stop using hOEM at any time by deleting it, and you may delete your account as set out in section 9. We may end your licence if you break these terms. Sections 4, 5, 11 and 12 continue to apply afterwards, and so does the permission in section 6 for any copy of the combined sound that has already been heard.

14  The Law That Applies

These terms are governed by the law of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction, except where the law where you live gives you the right to bring a claim locally.

15  Apple

hOEM is distributed through the App Store. Apple is not a party to these terms and has no responsibility for hOEM. Apple has no obligation to provide support for it. If hOEM fails to conform to any warranty that cannot be disclaimed, you may notify Apple and Apple will refund the purchase price, if any; beyond that, Apple has no other warranty obligation. Apple is a third-party beneficiary of these terms and may enforce them.

16  All Of It

These terms, with our Data & Privacy page, are the whole agreement between us about hOEM. If any part of them is found unenforceable, the rest continues to apply.
